- The Artworks are unique and there may be several simultaneous purchasers using the payment system to secure the same items. The website will make numerous checks during the purchase process to prevent two parties paying for the same Artwork (or paying a deposit for the same Artwork). However, in the event of any dispute over title, any liability or remedies are limited to a refund of the purchase price (or deposit) and the final purchase and the transfer of title is only confirmed by personal email from WWF-UK. WWF-UK retains the right to decide to whom any Artwork shall be sold.
- You acknowledge that the Artworks have been produced using the new experimental seaweed ink, OceanInk. Please note the Artwork does not need to be exclusively created using the OceanInk and may include other media. The medium OceanInk will be known as ‘seaweed ink’ on all art related labelling. WWF-UK cannot provide any warranty or undertaking as to the longevity or ongoing appearance of the Artwork or any other aspect concerning the OceanInk.
- The Artworks will be exhibited at Sotheby’s London, 34–35 New Bond Street, London W1A 2AA (inclusive). Any request to view the exhibition should be made to specialevents@wwf.org.uk.
- The buyer is responsible for all transport, additional packing and insurance costs and arrangements, and where necessary, complying with all UK export and receiving country import regulations. Please note you are responsible for insurance from the business day following notification by email of successful completion of purchase and transfer of title.
- WWF-UK and the Art For Your Oceans team will undertake a condition check upon de-installation and the Artwork will be packed by professional art handlers ready for collection or delivery.
- WWF-UK will be in contact with all purchasers to arrange collection upon completion of sale. Please keep the email confirming purchase and receipt (print or digital) as proof of purchase, and have this paperwork available with a Photo ID when arranging collection.
- Should the buyer wish to view the Artwork before collection, it will be at the buyer’s own risk and responsibility to unpack, examine and repack the Artwork.
- Should the buyer appoint an agent to collect the Artwork, this can be coordinated with WWF-UK.
- Collection will be for the buyer to arrange at their cost from 01 Art Services Storage once WWF-UK confirm sale is complete. From the notified date, the buyer will be liable for storage and release fees. Due to government legislation, WWF-UK is obliged to perform identity checks on high value orders. If a buyer seeks to purchase an Artwork over £8,000 (or multiple Artworks with a cumulative value over £8,000), this is defined as a high value order. If an Artwork you are seeking to purchase is over this threshold, a deposit of £8,000 will be taken through the website to secure your interest in such Artwork. WWF-UK will then get in touch with the purchaser to facilitate the required anti-money laundering checks (AML checks). Once this has been completed to WWF-UK’s satisfaction a pending purchaser will be notified and arrangement will be made to take the remaining payment, and complete the sale(s). The £8,000 deposit will secure the Artwork whilst the AML checks are completed. Please note only one purchase process can be undertaken at a time so a purchaser wishing to buy multiple Artworks will have to buy them each separately.
- For the AML checks, WWF-UK will require a copy of a valid photo identity document such as a passport, driving licence or national ID card. Where that identity document does not contain a residential address, additional proof of that is required, in the form of a bank or utility bill or other official correspondence, dated within the previous three months. If you are buying on behalf of a company, you will need to provide the company details including evidence of incorporation, directors and the ultimate owner. If you are an agent / advisor acting on behalf of a buyer, you will need to provide your details and those of the buyer. Payments will need to be received from the bank account of the buyer – that is an account held in the name of the person or company named on the order. In the instance that the AML checks should not be acceptable to WWF-UK or WWF-UK shall otherwise decide not to proceed with a sale, the full deposit will be refunded to the pending purchaser. Any personal information provided during the above process will be processed in accordance with our privacy policy (Privacy and data protection with WWF | WWF) and will remain secure and confidential. For full information on these AML checks and requirements, please visit the UK government anti-money laundering guidelines directly.
- If you should have any further questions regarding AML checks for the Art For Your Oceans Artworks, please contact WWF-UK at specialevents@wwf.org.uk.
- English law shall apply to these terms and conditions and any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
